PRIVACY POLICY

1. General

We inform you about the collection, processing and use of your personal data and the claims and rights to which you are entitled as a result. The data protection declaration is based on the terminology used by the European Directive and Regulation Maker when adopting the General Data Protection Regulation (DS-GVO).

"Personal data" in the sense of this privacy policy is data that relates to you and can be used to identify you personally (directly or indirectly).

2. Collection and use of personal data

 

2.1 Personal data collected

On the one hand, your data is collected by you providing it to us. Other data is collected automatically when you visit the website.

The types of personal data we may collect from you, depending on your use of the Website, include: Name, e-mail address, address, telephone number, date of birth, age, gender, other data that you provide to us (for example, also by filling out a contact form on our website), answers that you provide to us when participating in surveys, IP address, and other technical data that tells us how you use our website.

 

2.2 Use of personal data

Contact form: We collect the personal data you provide to us when you fill out forms on our website. We may use this personal information to process your request and/or provide the services or information you have requested.

Surveys: We may ask you to provide feedback on our services by participating in a survey. Participation is voluntary. We use feedback from surveys to evaluate our performance.

Our Business Purposes: we may use your personal information for our business purposes, ie: In the course of our business operations, to provide our services, to communicate with you, to maintain records, for statistical analysis, research purposes, to ensure network and information security, for evidentiary purposes in the event of an existing or threatened lawsuit, to analyze user behavior on our website, to customize various aspects of our website to optimize the user experience, to host, maintain and otherwise support the operation of our website, record retention/storage, database management, our protection of rights, property and/or safety, and to ensure the quality of the services we provide to our users.

Newsletters: when you sign up for a newsletter, you will receive a confirmation message containing a link to finalize your registration (double-opt-in). This ensures that the newsletter is explicitly desired. We use the personal data for the transmission of the newsletter. Unsubscribing from the newsletter is done via a personalized link that is sent with each mailing.

In addition, we may use your personal data for specific other purposes indicated at the time of collection.

2.3 Legal basis for the collection, processing and use of personal data

We process your personal data when the processing is necessary to comply with our legal obligations, to fulfill our contractual obligations, where you have consented to the processing, or based on our legitimate interest in: responding to your inquiry, providing the services or information you have requested, conducting surveys to obtain feedback on our services, for employee, customer and property protection measures, marketing and our internal business purposes listed above.

3. Transmission of data to third parties

The services we provide sometimes require the involvement of third parties. We have carefully selected these third parties and taken measures to ensure that your personal data is adequately protected. Your data will only be forwarded on the basis of the DS-GVO, in particular to fulfill your order or on the basis of your prior consent.

Order processors commissioned by us (e.g. service providers we use and to whom we make data available, etc) will only receive your data if they need your data to fulfill their respective service. All order processors have been contractually obligated by us to treat your data confidentially and to use it exclusively within the scope of their order.

We also disclose your personal data to our lawyers and similar advisors when we ask them to provide professional advice, to other third parties when we are required to disclose or share your personal data to comply with a legal obligation, to other third parties on the order of a court or authority or investors.

 

4. Retention of data

We will not retain your data for longer than is necessary to fulfill our contractual or legal obligations and to defend against any liability claims.

5. Data security

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation.

Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information you disclose to us via the Internet may be viewed and used by other persons.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking attack on email account or telephone).

6. Data subject rights

The following section explains your rights. The various rights are each subject to certain exceptions and conditions. Your request for information, deletion, correction, objection, revocation and/or data transfer, in the latter case provided that this does not cause disproportionate effort, can be addressed to the e-mail address or address given under point 10. We will only comply with your request to the extent that our assessment of your request shows that we may and must do so in accordance with data protection law.

You have the right to be informed in a clear, transparent and easily understandable way about your rights and about how we use your personal data. We therefore inform you about this in this data protection notice.

6.2 Right to information

You have the right to receive a copy of your processed personal data and certain other information about its use. We may refuse to release information if it reveals personal data about another person or if it would prejudice the rights of another person.

You may request us to take reasonable steps to correct your personal data if it is inaccurate or incomplete.

This right allows you to request the deletion or removal of your personal data if there is no compelling reason for us to continue using it or its use is unlawful. There is no general right to erasure and there are also exceptions.

You have the right to prevent further use of your personal data while we consider a request for rectification, or as an alternative to erasure. If processing is restricted, we may still store your personal data, but we may not continue to use it. We maintain lists of individuals who have asked to stop further use of their personal data to ensure that the restriction is respected in the future.

6.6 Right to data portability

You have the right to request certain personal data.

6.7 Right to object

You have the right to object at any time to certain types of processing on grounds relating to your particular situation, insofar as the processing is carried out for a legitimate interest pursued by us or by a third party. 6.8 Right to withdraw consent under data protection law.

Any person affected by the processing of personal data has the right to withdraw consent to the processing of personal data at any time. If the data subject wishes to exercise his or her right to withdraw consent, he or she may contact us at any time.

7. Cookies

This website uses "cookies" to make the service more user-friendly, effective and secure.

A "cookie" is a small text file that we transmit via their web server to the cookie file of the browser on the hard drive of your computer. This enables our website to recognize you as a user when a connection is established between our web server and your browser. 8. Google analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. We would like to point out that on this website Google Analytics has been extended by IP anonymization to ensure anonymized collection of IP addresses (so-called IP masking). Through IP anonymization on this website, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.

You can prevent the storage of cookies by selecting the appropriate settings on your browser software. 9. Server log files

In order to optimize this website in terms of system performance, user-friendliness and provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet Protocol address (IP address), browser and language setting, operating system, referrer URL, your Internet service provider and date/time.

We do not merge this data with personal data sources. We reserve the right to check this data retrospectively if it becomes aware of specific indications of unlawful use.

11. Payment Procedure

After booking with us, you have one week* to confirm it, no need to do any payment during the process! You will receive an email with access to the payment form, from where you will be able to pay with Paypal or find our bank details for bank transfers.

*In order to confirm your booking, the deposit of 25% is necessary. We will send you a payment confirmation email, mind that for bank transfer it may take a couple of days.

The second payment can be done 1 month before the arrival at JB Surf School.

12. Refund and Cancellation Policy

Justice's Brothers Surf School is an extremely high quality, tight margined program, with limited space.  Due to the seasonal nature of our programs and our investment into our staff, preparation, vendors, and equipment, before our programs, we have a strict cancellation and refund policy.  Expenses are contracted for the season and are based on our total group rather than a per person basis.  JB Surf School cannot recover program related expenses from cancellations even due to illness or injury, late arrival, leaving early, or cancellation for any reason. Therefore, once your student has been accepted into the program exceptions to this policy cannot be made for any reason, including weather or personal emergencies. In order to enroll in JB Surf School you must agree to the terms of the cancellation policy. If you must cancel your reservation, our policy is as follows:

  • Deposits (25%) are non-refundable.

  • If you cancel before 60 days prior to the first day of the program for which you are registered, your tuition will be refunded, minus your deposit.

The cancellation period is defined by the receipt of the cancellation. In cases of cancellation, the below fees may apply, depending on the cancellation date.

60 days in advance 10%
45 days in advance 20%
30 days in advance 40%
20 days in advance 70%
12 days in advance 100%

If a guest does not cancel and does not turn up, they will receive no refund.

  • Once your spot is reserved, we are no longer able to offer it to another participant.  Regardless of the reason for cancellation or if the cancellation occurs during the trip due to dismissal, medical, or another reason, JB Surf School is not able to provide any tuition refund.

  • JB Surf School is unable to refund any deposit and tuition for a program cancellation due to factors including, but not limited to natural disasters, fires, civil, military, or political unrest, government mandates, terrorism, travel restrictions, disease (including but not limited to a pandemic such as COVID-19), or other major global or local events.

  • There is no refund for arriving late or leaving early and no partial refunds for any services not used at camp.
